If you do not wish to go to court, the good news for you is that most personal injury cases settle out of court. While most personal injury lawyers (at least any lawyer who is worth your time and money) will prepare for trial anyways, in very few instances is there no chance for a settlement.
There are certainly benefits to being ready for court, however, even if it winds up to be unnecessary. Showing the other person or entity, usually an insurance company, that you are prepared for trial turns up the heat and pressures them into making a fair offer.

Additionally, there are alternative ways to have your case resolved without going to court. There has been a large movement in the legal and insurance industries to have cases resolved or negotiated through binding arbitration (where an arbitrator makes a final decision between the parties after hearing evidence), non-binding arbitration (where the terms set by an arbitrator are not legally binding) and mediation (another word for a structured negotiation).
We have had great success in resolving some of the most difficult cases through these alternative dispute resolution venues. Our clients are often very satisfied with the results we are able to achieve using these settlement tactics.
